The anti-choice segment of the Supreme Court, as I read their statements, claimed that individual states should have the right to determine their abortion policy. (Of course in reality, this means the gerrymandered, non-democratic state legislatures). But Graham claimed that Dodds allowed both the states and the federal government to determine abortion policy. So if Graham's legislation were to appear before the SCOTUS, then the court would have to rule against him.

This is the crazy world we have been sentenced to.
