The first draft of an "original" story that the AI programmer prints out is going to be based on previously written scripts or synopses that have been scanned into the AI hopper. This is why Sarah Silverman and others have sued over the use of their books to "train" AI.'
Outright plagiarism (as in Coming to America) is hard enough to prove. The studios will just argue that any original script uses plot elements, archetypes etc. from previous stories. AI has the potential to widen the gray area substantially, and the studios can hire better attorneys.
