Apologies for a hasty and unresearched response: the one branch of government that should not be reduced to a binary status is the Supreme Court (actually that’s the case with all the subsidiary courts as well — including appointments down the line to the county level like sheriff or coroner or clerk of court). If politicizing judicial (and other) appointments is a solution, then the solution is worse than the problem.
